 “It is prescribed, when death approaches any of you, if he leaves any goods, that he makes a bequest to parents and near relatives, according to reasonable usage; this is due from the God-fearing”

The importance of an Islamic will was explained clearly from 2 Hadiths:-

 “It is the duty of a Muslim who has anything to bequeth not to let two nights pass without including it in his Will”. (Sahih al-Bukhari)

 ” A man may do good deeds for seventy years but if he acts unjustly when he leaves his last testament, the wickedness of his deed will be sealed upon him, and he will enter the fire. If on the other hand, a man acts wickedly for seventy years but is just in his last will and testament, the goodness of his deed will be sealed upon him, and he will enter the garden”.  (Ahmad and Ibn Majah)

A Muslim is required to bear the pain and anguish of losing a loved one with patience, Pray to Allah to be merciful to the deceased’s soul and to remember that life on earth is only temporary and to prepare ourselves for the Next life. When a Muslim dies there are certain duties which are vital and need to be performed with regards to the distribution of the Deceased’s Estate:-

• Payment of funeral expenses
• Payment of his/her debts
• Carrying out of the Deceased’s bequests
• Distribution of the remaining estate amongst the heirs according to the Sharia Law

There are many advantages of having an Islamic Will such as:-

• If you die without leaving a Will you are deemed to have died ‘intestate’ and so your wealth will be distributed in accordance with the English rules on Intestacy which do not apply to the same criteria as those laid down by the Sharia Law.
• By writing an Islamic Will, you can create a better and secure life style for your children who are under 18 years of age by appointing legal guardians to care for them should something happen to both of the parents (i.e. sudden death of both parents.)
• By leaving a gift in your Will to a charitable cause – it helps not only the beneficiaries, but can help you too – for sadaqa jariya (ongoing charity) is an action that continues to be rewarded after death.
